Terms and Conditions

§ 1 Scope of Application and General Provisions

(1) These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between
Kugellagerhandel Karavar, Owner: [Karavar], Hermannstraße 20C, 35576 Wetzlar, Germany (hereinafter referred to as the “Seller”) and its customers.

(2) Customers within the meaning of these GTC are consumers (§ 13 German Civil Code – BGB) and entrepreneurs (§ 14 German Civil Code – BGB).

(3) Deviating terms and conditions of the customer shall not be recognized unless the Seller expressly agrees to their validity in writing.

(4) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

§ 2 Conclusion of Contract

(1) The products presented on the website do not constitute a legally binding offer but a non-binding invitation to submit an inquiry.

(2) By submitting an inquiry via the contact form, by email or by telephone, the customer makes a non-binding offer. A contract shall only be concluded upon the Seller’s explicit acceptance (e.g., order confirmation or invoice).

(3) The Seller reserves the right to reject offers without stating reasons.

§ 3 Prices and Terms of Payment

(1) All prices are stated in Euro. Unless otherwise indicated, they do not include VAT if the Seller is subject to the small business regulation / or: plus the applicable statutory VAT (depending on your tax status).

(2) Shipping costs shall be stated separately.

(3) Payment shall be made as agreed, usually by bank transfer.

(4) Payments are due immediately upon receipt of the invoice unless otherwise agreed. In the event of default of payment, the statutory provisions shall apply.

§ 4 Delivery and Delivery Time

(1) Delivery shall be made exclusively upon individual agreement.

(2) Stated delivery times are non-binding unless expressly confirmed in writing.

(3) Partial deliveries are permitted if reasonable for the customer.

(4) In the event of unforeseen circumstances (e.g., delivery problems from upstream suppliers), delivery times shall be extended accordingly.

§ 5 Retention of Title

The delivered goods shall remain the property of the Seller until full payment has been received.

§ 6 Warranty

(1) The statutory warranty rights shall apply.

(2) For entrepreneurs, the warranty period is 12 months from delivery unless intent or gross negligence applies.

(3) Entrepreneurs must inspect the goods immediately upon receipt and notify obvious defects in writing within 3 working days (§ 377 German Commercial Code – HGB).

§ 7 Liability

(1) The Seller shall be fully liable for damages resulting from injury to life, body or health.

(2) For other damages, the Seller shall only be liable in cases of intent or gross negligence. In cases of slight negligence, liability shall only exist in the event of breach of essential contractual obligations (cardinal obligations) and shall be limited to the typical contractual damage foreseeable at the time of contract conclusion.

(3) Liability for indirect damages, consequential damages or loss of profit shall be excluded unless mandatory statutory provisions provide otherwise.

§ 8 Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal in distance selling transactions. The withdrawal instructions with the statutory conditions shall be provided to the customer together with the offer or order confirmation.

Note: As no direct online shop is operated and contracts are concluded individually, withdrawal rights will be communicated on a case-by-case basis.

§ 9 Data Protection

The provisions of the privacy policy published on the website shall apply.

§ 10 Place of Jurisdiction and Final Provisions

(1) Place of performance and jurisdiction for all disputes with entrepreneurs shall be Wetzlar, Germany.

(2) Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the intended economic purpose.
